Divorce: Up n Run?
« on: October 06, 2014, 10:16:50 pm »
Dunno how many of you are privvy to my situation from zoklet but I need some advice on best course of action here. My girlfriend is Japanese and she's been married to an idiot and they have two kids together. They're in the midst of a pointless divorce. The guy inherited about 5 million dollars split between him and his sister. I guess she thinks shes entitled to some of it since he doesn't do jack shit for his kids but her lawyer said since its an inheritance shes only going to get half of his current assets which include a few cars, and a shitty little house. Now he is using ME against her because I've been living in the shitty little house with her because his sister (as half owner of the inherited house) allowed me to because, I'm taking care of the kids. Now his sister has decided to give up all rights to the house so I've got however long to live here until he serves me an eviction notice. As I said, he intends to use me against her in their divorce battle, I'm not sure how though.

I think it would be in her best interest to just take the kids and go back to her country, otherwise he is going to get partial custody and then she wont be able to take them out of the country without his permission. Shes in a losing situation and wont admit it. She thinks shes going to get some money out of him at the very least child support - which she wont get either even if ordered because he never has to work again so theres no way they can garnish him if he just doesn't pay - and she def wont have money to sue him for it.

Dude is probably going to kick her out of the house too - then shes got DHS about to be on her ass for fraud for simply not claiming me on her application even though we don't share expenses. Is this not a get the fuck out of dodge type of situation here?

What does her lawyer say about everything?  The laws about this stuff vary by state, assuming you're in the US.

Lawyer doesn't care about shit except making money so of course she wants to drag it on as long as possible and go to trial and blah blah blah. Shes focused on getting the divorce not what is in her client's best interest as far as living condition.

And exactly what gives her any right to leave the country with the kids putting distance between their father? Why shouldn't he have the right to  be in their lives? If anything, he should take some of the cash he is getting and try to get custody of them and let her worry about visitation rights. Your girl sounds like a big hot mess vs. a guy that is about to be a millionaire. They brought the kids into the world, what is MOST important is what is best for them.... their quality of life is paramount to anything else. Inheritance or no inheritance.

What about international law? I'm pretty sure Japan doesn't give a fuck about foreigners rights.

Now shes trying to TELL the lawyer she'll leave the country, I think its a bad idea and she should just keep it as her trump card and bail if shit hits the fan.

As I said, dude is straight retarded hence the divorce. He is a drug addict and habitually lies to his children on such a consistent level they call him out every time he makes a promise as simple as visiting them the next day or taking them to mc donalds. Also he is registered sex offender (pedophile) so if he gets custody, his daughter is most likely going to get raped when she starts developing.

millionsofdeadcats is there a name for this odd syndrome where people defend people with money just because they have money? Is it a just a coincidence I'm seeing this behavior in two completely unrelated threads?

I remember there was a case a few years ago where the mom took the daughter back to mexico before the case was over, she was extradited and did time for it.

I don't know why this happens, but I've only heard of this happening to people who flee the country and go to Mexico.

I haven't heard of any of these type of cases happening to anyone who fled to any other country, unless national security was involved

Is he a serious threat to his children?  In most states I don't see these court proceedings going his way.  Usually they favor the mother regardless, and if he's a sex offender?

Again, you should be seeking actual legal counsel instead of an internet forum, but I know of cases where men were denied even partial custody because of past mental health/drug addiction issues.  There were only allowed to see their kids at designated times with a social worker present.

Seems Japan just became part of some international child abduction treaty that technically would allow him to force her to come back but seems it's not likely to be enforced. Hes a threat in the sense that he  is incompetent. He takes them to mcdonalds for EVERY meal, gets blazed and just vegs as they play outside. Her lawyers is fucking stupid and wont try and demand he get a drug test to prove hes a capable parent but she is so INCONVENIENTLY hiring an interpreter for someone who speaks fluent english and tackign on a 200 fee for finding him. Bitch keeps sending billing statements every two weeks and charging 2 dollars even though we told her we don't fucking want any statements. Then charging a 500 dollar court preperation fee even though the court canceled that appointment so she charged an additional 500 court prep fee on top of the original one.

Many law offices give free consultations.  Call around your town, and explain all of this to them.  See what they think of everything.
