Title: Legality of selling fake drugs

Quite hypothetically, say I'm selling sugar in capsules as some sort of drug. A few situations, can I be prosecuted for selling said sugar as a drug and can I be prosecuted for being in possession of a substance that is not a classified drug but in capsule form, scales, etc. (United States)

It's fraud and you can be charged with possession with intent to sell. At least in America selling fake drugs counts legally as having the real thing.
