Title: can i get in trouble for selling something illegal i dont have?

Let's just use "weed" as an example. If I say I'm selling weed online not TOR. I create a believable website and add a lot of fake positive feedback from fake people would I get in trouble by the law even though I don't have weed I'm just scamming buyers? Because its against the law for buyers to get a hold of weed so would I be safe? If not then what about just advertising on forums?

Yes, its illegal and you can be charged.

I wonder if they would still pin you with conspiracy to sell/distribute.. The website alone is all they would need for that, doesnt matter whether or not the goods actually exist.

Thanks! I thought that if I claim to sell something illegal that most likely a fed would go undercover and purchase my shit because they need my shit as evidence to prove it in court but they'll get nothing so I thought I would be safe since everyone buying from me is breaking the law so its their risk. If I do get hit with something in court I believe it will be something minor just my opinion I couldbe wrong.

Having the illicit product or not is unrelated in this case. You'd get taken away for attempted fraud.

Yeah I guess its a dumb idea. I just know a guy who does this shit and makes good money doing it online. Gets more then 1k a week. He created a fake website and a lot of fake reviews. After people send in the money he sends an email back saying he robbed them and tells them in the email that if they go to the police they'll be in trouble too for breaking the law. His website still exist today. But he'll most likely get caught one day which I doubt.

Ngalos life story.  Ngalo you have so much to learn kid.  Unfortunately you are going to have to do some time before you realize that LE doesn't play around and the law isn't as rigid as Law&order makes it look.  Rule of thumb, if you have to ask, it's probably illegal.

Here's a for instance, say I stand on my local street corner and sell some nigga a bag of oregano for $20.  A cop sees the deal and catches us both.  I will go to jail even tho I didn't distribute anything illegal.  They can't charge you with the posession of whatever weight of a drug, but they can get you for distribution which is the worse of the two charges anyway.

Down here they call it "simulation" or "criminal simulation of a controlled substance." Basically, what everyone else has already said...you don't have to actually possess an illegal substance to be charged with a crime if you're representing something as being such. Running a website steps that up a notch to wire fraud as well.

Yeah it's fraud. If you get caught selling fake drugs you can be charged with possession with intent to sell and fraud. I assume if you didn't have the material at all the  it would just be fraud though.
