Title: if someone sends you something in the mail willingly, can they report it stolen?
Post by: AverageJane on September 15, 2014, 08:38:29 pm
I posted an ad on Craigslist looking to trade phones, this chick from like 2 hours away has been annoying and blowing up my phone even though I told her it was too far for a trade. She suggested we ship our phones to each other... which seemed kind of air headed on her part. She got the shipping info, costs, told me she would ship her phone after class tomorrow and email me the tracking number.

Well, what if I didn't send mine, sold it instead, hypothetically, and I receive her factory reset iphone 5s... could she involve authorities and report it stolen even though she sent it to me?

I feel bad that the thought crossed my mind but I'm just curious what the outcome could be. Lastly, if I took said phone to my wireless carrier and put my number on it and immediately changed it to my apple ID,  etc. Could she or apple do anything about it?

Hmmmm

They can brick your phone from Antarctica. They are Apple.

Even if I had it all set up under my info by the time she even realized? What a keeping people who sell their iphones from bricking them then? Nothing? Apple will brick them no matter what?

I'm not expert on Bad Ideas so better wait for someone with a lower social status than me.

I personally think she thinks she is going to scam you, but maybe that is just my suspicious mind at work.  But I would think that you will face no recourse if you do pull this off, who's to say that she didn't give you the phone as a gift?  No one, that's who.

That's what I was thinking. I checked out her Facebook page and she seems harmless so I don't think she is trying to scam me, I'm not even sure if I would scam her... it just crossed my mind.

Do you know if apple could brick the phone even if I got it to my wireless carrier store and put my number and account in it?

I have no idea, but why would they do that?  If she reports it stolen and tells the police she mailed it to some stranger, I doubt they would even file the report.

Yes, I am not sure if you are familiar with the concept of 'bad ideas', but there is an associated saying; 'Leave your morals at the door'.

Do you know if that would constitute as mail fraud, MODC?

If i were to insure my package for the value of my phone and put something in there that weighed similar, could she file a claim someone switched the items and get reimbursed for the phone so she can just go buy one?

That's not just theft, it's mail fraud, a federal felony.

All around, it's a stupid fucking idea. You're gonna give a girl your address and then defraud her?  How do you know her old man, daddy, or brother isn't going to come to your house, drag you out and fuck you raw?  You're more worried about the law, when you should be worried about fucking with random people you don't know who have your PI!

Consider mailing a box with a dollar in it to an address in the same zip code and give her the tracking from that. That's probably what she's doing to you anyway...

Apple's power has been somewhat reduced when this law (http://www.cbsnews.com/news/obama-signs-bill-unlocking-cellphones/) was passed. Sure... they still have the technical ability to kill the phone, but if you have proof of a transaction/trade/tracking the law should be on your side.

Of course you may want to reserve this option unless she rips you off.
