TL/DR:
The BATFE ruled that NFA trusts are not people
Current ban prohibits people from building machine guns
NFA trusts submitted Form 1's for the production of machine guns
BATFE approves the tax stamps, mails the approved Form 1's and stamps, and then goes "OH FUCK!!!!!1!!!111!!1one!!"

Those are the NFA trusts that I was talking about. Being able to Form 1 (build) a MG via a trust is a loophole that the BATFE only recently made when they officially declared that a trust is not a 'person'
Using a trust is the preferred method to get NFA items now because unfortunately their rights are more clearly laid out in law and the BATFE has less room to make and deliver their 'opinions' on certain subjects

exactly. everyone i know of with either a silencer or some other stamped toy has it through a business for just that reason
